Terms of Service

These Terms of Service ("Terms") govern your use of the estimating platform provided by estimating.services ("we", "us", or "our"). By creating an account or using the service, you agree to these Terms.

1. The Service

estimating.services provides cloud-based electrical estimating software accessible via a web browser. We grant you a non-exclusive, non-transferable licence to use the platform for your internal business purposes, subject to these Terms and payment of the applicable subscription fee.

2. Accounts & Access

You must provide accurate information when creating an account. You are responsible for maintaining the security of your login credentials and for all activity that occurs under your account. Notify us immediately at info@estimating.services if you suspect unauthorised access.

Each subscription covers one named user (seat). You may not share login credentials between multiple individuals.

3. Subscription & Payment

Access to the platform requires a paid subscription. Subscriptions are billed monthly per seat. Payment is processed by Stripe. By subscribing, you authorise us to charge your payment method on a recurring basis until you cancel.

Cancellation

You may cancel your subscription at any time via the billing portal in your account. Cancellation takes effect at the end of the current billing period. We do not provide refunds for partial months.

Failed payments

If a payment fails, we will notify you and attempt to collect payment again. If payment is not resolved within a reasonable period, we may suspend access to your account.

4. Your Data

You retain ownership of all project data, estimates, and other content you create on the platform. We do not claim any intellectual property rights over your data.

You grant us a limited licence to store, process, and display your data solely for the purpose of providing the service to you.

5. Acceptable Use

You agree not to:

• Use the platform for any unlawful purpose
• Attempt to gain unauthorised access to other accounts or systems
• Reverse engineer, decompile, or attempt to extract the source code of the platform
• Use the platform to transmit harmful, offensive, or infringing content
• Resell or sublicence access to the platform without our written consent

6. Intellectual Property

The platform, including its design, code, and content (excluding your data), is owned by estimating.services and protected by copyright and other intellectual property laws. Nothing in these Terms transfers any intellectual property rights to you.

The materials library, assembly templates, and pricing data provided within the platform are part of the service and may not be exported or reproduced outside of normal platform use.

7. Availability & Support

We aim to keep the platform available at all times but do not guarantee uninterrupted access. Scheduled maintenance will be communicated in advance where possible. We provide support via email at info@estimating.services.

8. Disclaimer of Warranties

The platform is provided "as is". To the extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the platform will be error-free or that estimates produced using it will be accurate for any specific project.

9. Limitation of Liability

To the maximum extent permitted by applicable law, our total liability to you for any claims arising out of or related to these Terms or the platform shall not exceed the total subscription fees you paid in the three months preceding the claim. We are not liable for any indirect, consequential, or incidental damages.

10. Termination

We may suspend or terminate your account if you breach these Terms, fail to pay, or engage in conduct that we reasonably believe is harmful to other users or to us. Upon termination, your right to access the platform ceases immediately. You may request an export of your data within 30 days of termination.

11. Governing Law

These Terms are governed by the laws of Queensland, Australia. Any disputes will be resolved in the courts of Queensland.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email. Continued use of the platform after the effective date of any changes constitutes acceptance of the updated Terms.
